This document, to which the Terms and Conditions of Use for the website
www.svvfarrando.com (hereinafter the “Site”), is intended to inform you of our practices regarding the processing and protection of your Personal Data,
as defined below.
We encourage you to carefully read all the information we provide, and if you have any questions, please contact us.

1- Definitions

“Data ”: refers to any information that allows for the direct or indirect identification of a natural person by reference to an identification number or to one or more factors specific to that person. You will never be asked to provide so-called “sensitive” personal data, such as your racial or ethnic origin, your political, philosophical, or religious views, or information regarding your income or tax status.

Your Data is collected solely for the purpose of using and understanding the Site and its Services, as well as for the purposes described in Article 4.

The Sales Operator acts as the data controller for your Data collected when you use the Site to provide you with the Services. This means that the Sales Operator is responsible, in particular, for the collection, security, and use of your Data for the purposes described herein, in accordance with data protection regulations. The Sales Operator does not rent or sell its customer files to third-party commercial entities unrelated to the Services as defined in the Site’s Terms of Use.

Newsletter: An informational, promotional, or advertising email sent by the Sales Operator to Users who have provided their contact information for the purpose of receiving the Sales Operator’s Services.

“Services”: All services offered by the Sales Operator on the Site and described in Article 3 of the General Terms of Use;

“User” / “ You ”: Refers to any person using the Site’s Services.

2 - Consent

By using our Services, you agree to provide accurate information about yourself and you understand and accept that your Data may be collected, used, stored, and transmitted to third parties as described below for the purpose of providing the Services you wish to receive.

3 - Data Collected

We may collect the following categories of Data:

a. Website Browsing

Connection data. Each time you connect to the Site, we passively collect information such as, among other things, your computer’s IP address, the date and time of connection, and information about your browser.
Browsing Data. We also collect information that allows us to identify how you access the Site, which pages you view, and for how long.
We may use cookies as described below.

b. Purchase Orders, Telephone Bids, and Online Appraisal Requests

When you place a Purchase Order or a Telephone Bid, or when you request a free online estimate, we collect certain information such as your first and last names, your mailing address, email address, phone number, and date of birth, as well as your purchase history and details, and the number and amounts of your bids.
This information is required by the Auction Operator to comply with the legal obligation to formally identify its customers, to which it is subject, particularly in the context of anti-money laundering efforts.

c. Newsletter Subscription

In accordance with the Terms and Conditions of Use, when you subscribe to a newsletter on the Site, you will be asked to provide certain information, including your first and last names, your mailing address, your email address, your phone number, and your date of birth…
This information is required by the Sales Operator to send you newsletters corresponding to your desired product categories and sales offers.

d. Banking Information

When you pay an auction invoice online, you will be asked to provide your banking information to ensure payment of your invoice or to guarantee your participation in the auction.
When you make an advance deposit, your information is requested to guarantee your payment for a lot in the event you win the bid. The Auction Operator may decide to withdraw the deposited amount prior to the auction as a security deposit pending your full payment.
However, this data is transmitted directly to the Auction Operator’s payment service provider, Ingenico, which is PCI-DSS certified through its own services.
If you refuse to pay your invoice online, the Auction Operator will contact you and process your invoice using the methods described on the Site.
We do not retain this Data, which is collected and stored securely by the Sales Operator’s payment service provider, Ingenico, a PCI-DSS-certified company. This standard is an international security standard designed to ensure the confidentiality and integrity of cardholder data and thereby safeguard card and transaction data.
When you place a Purchase Order or submit a request for a Telephone Bid on the Site, the Sales Operator will ask for your banking information to verify the validity of your bank account. However, this information is retained only for the duration of the auction.

4 - Purposes of Collecting Your Data

Your Data is collected to enable us to provide you with the Services and to fulfill one or more of the following purposes:
- To enable you to use the Site,
- To provide a history of submitted Purchase Orders and Telephone Bidding requests,
-To ensure the proper execution of transactions initiated by Users, such as Purchase Orders and Telephone Bids,
-To provide a free appraisal service for listed items;
-To provide effective customer service, particularly regarding assistance with using the Site and handling complaints,
-Compile a database of Users, customers, and prospects,
-Send newsletters, solicitations, and promotional messages based on preferences selected from among the categories of items offered,
-Compile internal sales and traffic statistics for the Services;
-To manage any disputes regarding the use of the Services and the Site;
-Combat fraud,
-To manage your requests regarding your right of access, rectification, and objection to the collection of your Data,
-Comply with our legal and regulatory obligations.

When we collect your Data, we will inform you whether certain Data fields are required or optional. If you do not fill in these required fields, you will not be able to access the Services.

You can subscribe to our newsletter by checking the box on the corresponding page of the Site.

You can unsubscribe from the newsletters at any time by clicking the unsubscribe link at the bottom of the emails you receive.

If the unsubscribe link does not work, you can unsubscribe by sending a message to the address listed in Article 13.

5 - Recipients of the Data

a. Our Service Providers

We share your Data with our own service providers located in the European Union, in particular to perform services and actions at our request and on our behalf, such as verifying the validity of your phone number, sending promotional and marketing emails or text messages, or managing your transactions.
We use and process your connection data to identify, isolate, and resolve malfunctions and errors in telecommunications systems.
We may also use connection data to detect any illegal use of telecommunications systems and services.

b. Judicial Authorities

In accordance with applicable legal provisions, the Sales Operator may be required to provide information to competent authorities and courts for the purposes of criminal prosecution. The Sales Operator may not notify you of the disclosure of your Data to authorized third parties.
Data Retention Period
We retain your Data only for the period necessary to provide our Services and for up to three (3) years after you subscribe to the Newsletter.

At the end of this three (3)-year period, the Sales Operator may contact you again to ask if you wish to continue receiving information about the Sales Operator’s products and services. In the absence of any explicit action on your part, your Data will be archived or deleted in accordance with applicable legal provisions.

In the event of a breach of the Terms of Use or this Privacy Policy, the Sales Operator reserves the right to deny access to the Site’s Services under the conditions described in the Terms of Use.

In accordance with Article L.123-22 of the Commercial Code, the Sales Operator retains, for a period of ten (10) years from the end of the contractual relationship and for the purposes of billing and accounting, all data pertaining to successful bidders.

Similarly, the data of successful bidders is archived for the purposes of managing contracts between merchants and non-merchants or between merchants for a period of five (5) years from the end of the contractual relationship, in accordance with Article L.110-4 of the Commercial Code. In accordance with Article 213-1 of the Consumer Code, this period may be extended to ten (10) years when the contract is concluded electronically with a consumer and involves an amount equal to or greater than 120 euros, and the Sales Operator guarantees access to this data to the winning bidder at any time upon request.

Upon the expiration of this period, the Auction Operator agrees to delete or anonymize the data in its possession.

7 - Security

We have implemented technical and organizational security measures to ensure the security, integrity, and confidentiality of all your Data and to prevent it from being lost, stolen, damaged, altered, or disclosed to unauthorized persons.

We store your Data on servers located within the European Union.

8 - Cookies

Cookies are text files stored in your browser. They are created when a User’s browser loads a given website: the site sends information to the browser, which then creates a text file.
Each time you return to the same site, the browser retrieves the file and sends it to the website’s server.
When you visit the Site for the first time, a warning banner appears asking if you consent to the use of cookies while browsing. These cookies will be enabled once you give your consent.
This banner informs you that continuing your visit to the Site constitutes your consent to the use of cookies—for which your authorization is required—while you browse.

a. Cookies Used

The Sales Operator uses Google Analytics to collect information about your use of the Site.

Google Analytics is a marketing analytics service operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States.
Google Analytics uses codes consisting of text and numbers that will be stored on your device and used to analyze your use of the Services.
The information generated by cookies regarding your use of the Services (including your IP address) will be transferred to and stored by a Google server.
Google will use this information to evaluate your use of the Services, prepare activity reports for website operators, and provide other services related to website and Internet usage.
Google may transfer this information to third parties if required by law or if third parties process this data on Google’s behalf.

Google Analytics retains information about:
-The pages you visit on the Site;
- The time you spend on each of these pages;
-The links that led you to the Site;
-What you click on while browsing the Site.

We do not use retargeting advertising cookies or any other advertising pixel services that track whether users have performed specific actions on a site after clicking on an advertisement appearing on one of the pages.

b. Purposes of Cookie Use

9 - User Rights

The Data you provide is necessary for the provision of the Services you have subscribed to. You may not, therefore, withdraw your consent to the processing of Data necessary for the provision of the Service unless you stop using the Services.
You may, however, view, modify, or request the deletion of your Data for legitimate reasons at any time by contacting us at the address provided in Section 13 below. The Sales Operator will provide information regarding the action taken within one (1) month of your request. Requests to restrict processing or to have your Data ported are handled under the same conditions. This one (1)-month period may, however, be extended by two (2) months, provided that you are first informed of the reasons for the extension within the initial one (1)-month period.
You may also object at any time to the processing of your Data to which you have previously given specific consent for marketing purposes.
The Sales Operator will provide you, free of charge, with information regarding the Data stored about you. This information may be provided electronically if you wish.
For your security, please understand that in the event of a request for information or a change, we must verify your identity. Your identification document will not be retained following your request.
The Sales Operator undertakes to notify all recipients of the Data processing of your request.

10- Disposal of Data After Death

You have the right to issue, with your specific consent, instructions regarding the retention, erasure, and disclosure of your Data after your death. You may modify or revoke these instructions at any time.
You may designate a person to carry out your instructions. Upon your death, this person is authorized to review the instructions and request their implementation from the Sales Operator. If no one is designated, or unless otherwise specified in your instructions, in the event of the designated person’s death, your heirs are authorized to review your instructions and request that the Sales Operator implement them.

In the absence of instructions or unless otherwise specified in your instructions, your heirs may exercise your rights to the extent necessary to:
- Organize and settle your estate. In this regard, your heirs may access the processing of Data concerning you in order to identify and obtain information relevant to the settlement and division of the estate. They may also receive digital assets or data constituting family mementos that are transferable to the heirs;
-Ensuring that the Sales Operator takes your death into account. In this regard, your heirs may object to the continued processing of Data concerning you or request that it be updated.

When your heirs make such a request, the Sales Operator must provide proof, at no cost to the requester, that it has carried out the actions requested by the heirs.
Disputes among heirs regarding the exercise of these rights shall be brought before the competent district court.

11- Changes to the Privacy Policy

The Sales Operator reserves the right to amend the Privacy Policy at any time; the Privacy Policy remains applicable for the entire duration of your use of the Site and Services. In the event of an amendment, the Sales Operator will notify you by email.

If you do not accept these changes, you agree to stop using the Services. Otherwise, your use of the Services is subject to the terms of the new version of the Privacy Policy.
Any access to the Services following notification by the Sales Operator of the new version of the Privacy Policy constitutes your full and unconditional acceptance of this new version of the Privacy Policy.

The new version of the Privacy Policy applicable to the Services is available on the Website. The Sales Operator encourages you to review it whenever you place a Purchase Order or submit a Bid Request
or online request for an estimate.

The Sales Operator also reserves the right to modify or suspend, without cause, all or part of the Services.

Any modification or discontinuation of the Services does not entitle you to any compensation whatsoever.

12 - Disputes

In the event of a dispute regarding the use of your Data, you may file a complaint with the French Data Protection Authority (Commission Nationale de l’Informatique et des Libertés).

Since this data is retained solely for evidentiary purposes, it must be archived so that it no longer appears in the active database and is accessible only to authorized individuals by virtue of their position.
